KW AccessAbility MAX Vision AI Glasses Lending Programme

PARTICIPANT AGREEMENT TO TERMS OF EQUIPMENT LOAN

 Participants in the MAX Vision AI Glasses Lending Programme  must be Members of Kitchener-Waterloo AccessAbility.

To maximize community access and programme sustainability, participation in the MAX Vision AI Glasses Lending Programme is offered under a lifetime equipment loan model subject to the terms below--

a. Ownership

All AI Glasses and related accessories provided under this Project shall remain the sole property of Kitchener-Waterloo AccessAbility (“KWAA”) at all times.

b. Duration of Loan

KWAA grants the Participant a non-transferable, revocable license to possess and use the AI Glasses for the duration of their active participation in the MAX Vision AI Glasses Lending Programme.  The loan shall continue indefinitely provided the Participant:

Continues to use the device for its intended purpose;

Remains actively engaged in the MAX Vision AI Glasses Lending Programme; and

Remains in compliance with all participation requirements set out in Section 3.2.

KWAA reserves the right to request return of the device upon termination of participation or breach of this Agreement.

c. Care and Responsibility

The Participant agrees to exercise reasonable care in the use, storage, and maintenance of the AI Glasses. The Participant shall be responsible for any loss or damage resulting from negligence, misuse, or failure to follow KWAA’s care guidelines. The device may not be sold, loaned, pledged, or otherwise transferred to any third party.

3.2 Participant Obligations

In consideration of access to the AI Glasses and associated training, the Participant agrees to:

a. Training & Community Engagement

Attend a minimum of one (1) Lunch & Learn Focus Group or Training Session per calendar month. These meetings provide skills development, peer support, technical updates, and program feedback.

b. Acknowledgement of Support

Provide written thank-you correspondence to the MAX Vision AI Glasses Lending Programme sponsors and supporters as requested by KWAA, not to exceed four (4) times per calendar year.

c. Image and Story Consent

Grant KWAA and its project sponsors permission to capture, use, and publish photographs, video, and testimonials of the Participant during programme activities for promotional, educational, and fundraising purposes. KWAA will make reasonable efforts to notify Participants in advance of media capture. The Participant may revoke this consent in writing with 30 days’ notice, however KWAA cannot retract materials already published.

While there may be extenuating circumstances, the MAX Vision AI Glasses Lending Programme Participants are expected to make a sincere and good faith effort to meet the terms of this agreement.

3.3 Return of Equipment

Upon request by KWAA, the MAX Vision AI Glasses Lending Programme Participant shall promptly return the AI Glasses and all accessories in good working condition, subject to normal wear and tear.
